KUMAR ORAL ORDER 10-04-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with Deepnagar P. S. Case No. 93 of 2016 registered for the offences punishable under Section 395 of the Indian Penal Code.
Informant in his written complaint on 11.5.2016 has stated that on 22.4.2016 he entered into his newly constructed house and in the night while he and his family members were sleeping, 5 to 6 armed miscreants entered into his house and overpowered them and thereafter looted Rs.20,000/- to Rs. 25,000/-, gold ornaments and other household articles. A case has been registered against unknown. Name of petitioner has surfaced in this case on the basis of confessional statement made by co-accused Meghan Paswan and except confessional
Patna High Court Cr.Misc. No.14934 of 2018(3) dt.10-04-2018 2/2 statement of co-accused, there is no incriminating material against petitioner. FIR was lodged after much delay and nothing has been recovered from possession of petitioner. It has further been submitted that similarly placed accused, namely, Ranjit Manjhi, has been granted bail vide Cr. Misc. No. 33273 of 2017 dated 20.7.2017.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned CJM, Nalanda at Biharsharif in connection with Deepnagar P. S. Case No. 93 of 2016.
