====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 27-03-2018 Heard learned counsel for the petitioner, learned counsel for the informant and the learned Additional Public Prosecutor.
This is a petition for grant of regular bail in connection with Laheri P.S. Case No. 513 of 2017 for offences under Sections 420, 406, 504 and 506/34 of the Indian Penal Code.
Allegation, in brief, is that the accused persons had opened the account of the victim in Jeevandeep Bank, a nonbanking institution, and deposits were received from the depositors and on maturity no money was given and they have misappropriated the money.
Learned counsel for the petitioner submits that in the case diary it is shown that the evidence has come that Choudhari Braj Kishore Kumar, the elder brother of the
Patna High Court Cr.Misc. No.9255 of 2018(4) dt.27-03-2018 2/2 petitioner was the owner and manager of the said non-banking institution and the petitioner was also one of the employees. The petitioner is an engineering graduate and he has no criminal antecedent.
The learned counsel for the informant submits that the informant got deposited Rs.5,00,000/- in the name of her husband and that money was not given on maturity. Having considered the aforesaid facts and circumstances that the manager of the non-banking institution was Choudhari Braj Kishore Kumar, the elder brother of the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Laheri P.S. Case No. 513 of 2017 to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif.
