JUSTICE ARUN KUMAR ORAL ORDER 10-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 30.1.2018, seeks bail in Pothia PS Case No. 21 of 2018 registered under Section 393 of the IPC.

The allegation in brief is that while he informant was going to another village, on the way two miscreants stopped him, tried to snatch the motorcycle but in the meanwhile on alarm the villagers turned up and the miscreants flee away but the petitioner was apprehended.

Learned Counsel for the petitioner submits that motor cycle of the petitioner was hit by the informant's motorcycle and therefore quarrel took place and the informant got the petitioner arrested, he has got no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Intesab @ Md. Intesab is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM lst, Kishanganj in connection with Pothia PS Case No. 21 of 2018 only on verification of criminal antecedent of the petitioner and if any criminal antecedent is found he shall not be released.
