2. Earlier, the bail application of petitioner was rejected vide order dated 21.03.2024 passed in Cr. Misc. No. 86313 of 2023.
3. As per the prosecution case, 37.300 kg ganja and mobile phones were recovered from the dicky of car in which this petitioner and two others were seated.
4. Learned counsel for the petitioner submits that similarly situated co-accused, namely, Ajay Kumar has already been granted regular bail by this Hon'ble Court vide order dated 03.05.2024 passed in Cr. Misc. No. 76301 of 2023. No incriminating material has been recovered from possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner is in custody since 24.06.2023. Chargesheet has already been submitted.

5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Katihar in connection with NDPS Case No. 26 of 2023 arising out of Balia Belon P.
