2. Heard learned counsel for the petitioner and learned A.P.P. for the State.
3. The petitioner seeks bail in connection with Bahera P.S. Case No. 79 of 2024 dated 24.07.2024 registered for the offences punishable under Sections 302, 201 and 120B of the I.P.C.
4. As per the prosecution case, the petitioner and the coaccused persons are alleged to have killed the daughter of the informant due to non-fulfilment of demand of Rs. 2,00,000/- as dowry.
5. It has been submitted by learned counsel for the
Patna High Court CR. MISC. No.78175 of 2024(3) dt.19-02-2025 2/2 petitioner that the petitioner has falsely been implicated in the present case. The petitioner has neither tortured the deceased nor demanded any dowry. The petitioner is the brother-in-law (Dewar) of the deceased. He is separate in mess and property from the husband of the deceased. He has no concern with the alleged offence. There is general and omnibus allegation against the petitioner. The petitioner has clean antecedent as stated in paragraph no. 3 of the bail application. The petitioner is in custody in this case since 09.05.2024.
6. Learned A.P.P. for the State has opposed the prayer for bail petition of the petitioner.
7. Considering the aforesaid facts and circumstances of the case as well as the period of custody, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., Benipur, Darbhanga in connection with Bahera P.S. Case No. 79 of 2024.
8. The application stands allowed.
