2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 126 ( 2 ), 115 ( 2 ), 109, 74, 303 ( 2 ), 352, 3 (5) of the BNSS. 3 . As per F.I.R., on the alleged date and time of occurrence , all the accused persons and armed variously came on the land of the informant with intention to plough

No.79677 of 2024(3) dt.22-01-2025 2/3 the field and when the informant got the information regarding the same , he along with one Pratima Devi went there and upon objection by this informant, all the accused persons assaulted informant and others due to which they sustained injury .
4. It is submitted on behalf of the petitioners that both the parties are pattidar. As a matter of fact, on the alleged date and time of occurrence , informant sides were trying to grab the land of these petitioners due to which , a simple occurrence of maarpeet took place between both the parties. Moreover, a title suit is already pending between the parties for the aforesaid land. Allegation of assault is general and omnibus. Doctor has found the injury simple in nature . Petitioners claim clean antecedent.
5 . Learned counsel for the State oppose the bail petition .
6 Considering the nature of injury , clean antecedent of these petitioners and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Bettiah West Champaran in
Patna High Court CR. MISC. No.79677 of 2024(3) dt.22-01-2025 3/3 connection with Majaulia P.S. Case No. 491 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
