2. The petitioner seeks bail in connection with Chhabilapur P.S. Case No. 20 of 2023 instituted for the offences under Section 395 of the Indian Penal Code.

3. As per prosecution case, 10-11 unknown miscreants came at the farmyard of the Informant and after tying his legs and hands, loaded the paddy on the pickup van and fled away from there.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. The petitioner is not named in the F.I.R. and his name has surfaced in this case on the basis of the confessional

No.78271 of 2023(2) dt.06-12-2023 2/2 statement of co-accused/Sachin Kumar @ Shanti Yadav who has been granted bail by a Co-ordinate Bench of this Court dated 01.11.2023 passed in Cr. Misc. No. 64627 of 2023. The petitioner has two criminal antecedents out of which in one of them, he is on bail. The petitioner is in custody since 12.06.2023.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.

6. Considering the entire facts and circumstances of the case as also taking into account the period of custody, let the petitioner, abovenamed, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Chhabilapur P.S. case No. 20 of 2023.
