Petitioner, already in custody, seeks bail in connection with Bakhtiarpur Junction Rail (G.R.P.) P.S. Case No.44 of 2016, registered under Section 414 of the Indian Penal Code as well as under Sections 25(1-b)a, 26, 35 of the Arms Act. Allegation in brief is that two persons were apprehended on the railway platform and said to have planned to commit dacoity in the train and disclosed the name of their associates who succeeded in escaping away including the petitioner.

Learned counsel for the petitioner submits that the petitioner is not apprehended at the spot, only his name was

No.8765 of 2018(5) dt.10-04-2018 2/2 disclosed in the confessional statement by the persons apprehended and similarly situated other two co-accused Chhote Paswan @ Sanjeet Kumar and Jwalla Kumar @ Jwalla Yadav have been admitted to bail by coordinate Benches of this Court vide Cr. Misc. Nos.25139 of 2017 and 53042 of 2016 on 14.07.2017 and 22.12.2016 respectively.

Having considered the aforesaid facts and circumstances, petitioner Dularchand Kumar @ Amar Kumar @ Dularchandra is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Railway, Patna in connection with Bakhtiarpur Junction (G.R.P.) Rail P.S. Case No.44 of 2016.
