The petitioner seeks modification of the order dated 27.09.2019 passed in Cr. Appeal (SJ) No. 3829 of 2019 to the extent that the name of father of appellant / Pramod Mahto be read as Laxman Mahto @ Kailu Mahto in place of Surendra Mahto.

In this application, no proof of the fact that the name of the father of Pramod Mahto is Laxman Mahto @ Kailu Mahto has been brought on record.

No.70437 of 2019(2) dt.01-07-2020 2/2 However, this Court directs that in case the appellant / Pramod Mahto surrenders before the court below within a period of six weeks and satisfies the court below with documentary proof that his father is Laxman Mahto @ Kailu Mahto, he shall be granted the privilege of the order which has been passed on 27.09.2019 in Cr. Appeal (SJ) No. 3829 of 2019.

The modification application stands allowed to the extent indicated above.
