JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 399, 402 and 414 of the Indian Penal Code and Section 25 (1-b)a/, 26 and 35 of the Arms Act and Section 8 and 20(b) (ii) (C)/ 22 of the Narcotic Drugs and Psychotropic Substances Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 07.05.2022 and is a person with clean antecedent and is a young boy aged about 21 years and from perusal of the seizure list it would manifest that a mobile was recovered from his possession along with a motorcycle, it is next submitted that country made pistol along with cartridges and charas was recovered from the possession of Md. Hasim

Patna High Court CR. MISC. No.1417 of 2023(2) dt.04-03-2023 2/2 Lahri. It is next submitted that petitioner has been falsely implicated in the present case, it is also submitted that the motorcycle does belong to him and as far as recovery of charas is alleged the same is from Md. Hasim Lahri.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bela P.S. Case No. 116 of 2022.

One of the bailors of the petitioner shall be his cousin brother Vishwanath Chaudhari.
