2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code.
3. It is alleged by informant that on 14.09.2023 (evening), co-accused Ashok Kumar with unknown persons came to her house and carried her husband on motorcycle and on the next morning, the dead-body of her husband was found in a bush near block.
4. it is submitted on behalf of the petitioner that petitioner is not named in the F.I.R. and his name transpired during course of investigation in confessional statement of coaccused Ashok Kumar, who has already been granted regular by a coordinate Bench of this Court, vide order dated 01.08.2024
Patna High Court CR. MISC. No.73929 of 2025(2) dt.05-02-2026 2/2 passed in Cr. Misc. No. 37500 of 2024. There is no allegation of any specific overt act against the petitioner and the only material that has come against petitioner is that he was in touch with coaccused Ashok Kumar at the time of incident through mobile phone. Save and except suspicion, there is no other material on record to show complicity of the petitioner in the alleged offence. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.

Considering backdrop of the case, nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Belaganj P. S. Case No. 622 of 2023, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
