1. Heard learned counsel for the parties concerned.

2. This application has been filed for modification of the order, dated 28.07.2023, passed in Criminal Misc. No. 38784 of 2023, whereby the present petitioner has been granted privilege of anticipatory bail by this Court subject to the condition that the petitioner shall surrender before the learned Court below within a period of four weeks from the date of the order.

3. Learned Counsel for the petitioner submits that the petitioner could not surrender before the learned court below due to old age and illness. He accordingly prays for further two weeks' time to surrender before the learned Court below. He further submits that in the order, dated

Patna High Court CR. MISC. No.80387 of 2023(3) dt.15-12-2023 2/2 28.07.2023, in paragraph-4, incorrect mobile no. 8170906980 of the petitioner has been written inadvertently, instead of mobile no. 9939110176.

4. In view of the above, let the mobile no. 9939110176, mentioned in paragraph-6 of the modification application, be treated as correct.

5. Having regard to the submissions made on behalf of the petitioner, let the time granted by this Court to surrender before the learned Court below by order, dated 28.07.2023, passed in Criminal Misc. No. 38784 of 2023, be extended further by two weeks from today, subject to the deposit of a sum of Rs. 1000/- before the District Legal Services Authority, Madhubani.

6. Accordingly, this application is allowed to the extent indicated above.
