The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 342, 323, 354, 379, 34 of the Indian Penal Code.

As per F.I.R., 3-4 unidentified miscreants assaulted the informant and attempted to outrage the modesty of aunt of informant and thereafter, took away motorcycle of the informant.

Petitioner is not named in the F.I.R. and his name has transpired during course of investigation in the confessional statement of co-accused. Save and except confessional statement, there is no other material against this petitioner to show his involvement in the aforesaid crime. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.74543 of 2022(3) dt.19-06-2023 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Aurangabad Town P.S. Case No. 538 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
