====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 18-12-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State as also the learned counsel for the informant.

The petitioner seeks bail in connection with Daudnagar P.S. Case No.217 of 2018 registered under Sections 364/34 of the Indian Penal Code.

The accusation is that Sharafat Quraishi alias Baley, the son of the informant Akbari Khatoon, on receiving the call through two mobile nos.9076334279 and 9709529681 moved from the house, saying that he is going to attend the party of a friend at Rafiganj in the evening of 13.05.2018 but he did not return. Before 2-3 months, the occurrence of "Maar-Peet" took place in between Md. Tarik Anwar, this petitioner and Ashraf

Patna High Court CR. MISC. No.74417 of 2019(2) dt.18-12-2019 2/2 Quraishi with Sharaft Quraishi alias Baley, the son of the informant, and this petitioner had also lodged a case. The informant raised suspicion about having hand of the petitioner in the kidnapping and murder of her son.

Learned counsel appearing on behalf of the petitioner submits that except suspicion raised by the informant in kidnapping and murder of her son against the petitioner, there is nothing to show the involvement of the petitioner. The petitioner is in custody since 19.08.2019 and, on investigation, the police has already submitted the chargesheet against the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Daudnagar, District-Aurangabad, in connection with Daudnagar P.S. Case No.217 of 2018.
