2. Petitioner seeks regular bail in connection with Nauhatta P. S. Case No. 101 of 2025 in a case registered for the offences punishable under Sections 191(2), 190, 103(1) of the Bharatiya Nyaya Sanhita and under Section 3⁄4 of Bihar witch (Daain) Practices Act, 1999.

3. As per the prosecution case, the petitioner and the other co-accused persons are alleged to have killed the wife of the informant by throttling.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that though the petitioner is named in the FIR but there is no specific allegation of overt act

It is further submitted that there are general and omnibus allegation levelled against the petitioner and there is case and counter case between both the parties. Petitioner is in custody since 13.06.2025. Charge-sheet has already been submitted.

5. However, learned A.P.P. for the State vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case as well as the fact there is no specific overt act alleged against the petitioner and also considering the period of custody coupled with the fact that the petitioner has clean criminal antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-10, Rohtas, Sasaram/concerned Court below in connection with Nauhatta P. S. Case No. 101 of 2025.
