2. The petitioner apprehends her arrest in a case registered for the offence under Sections 103(1), 3(5) of the B.N.S., 2023 and Sections 25(1-b)a, 26, 27, 35 of the Arms Act.
3. The informant alleges that his son was coming back home after cleaning the temple, when he was intercepted by the accused persons including the petitioner and the accused persons said to kill him, on which, Santosh fired but then missed, thereafter again fired causing injury on chest, leading to his death.
4. Learned counsel for the petitioner submits that as per F.I.R. itself, specific allegation of firing is against Santosh, who has been arrested. He further submits that since petitioner is sister of co-accused Santosh, she has been implicated in this
Patna High Court CR. MISC. No.78635 of 2025(2) dt.19-11-2025 2/2 case along with her other family members. He next submits that from perusal of the allegation, as alleged in the FIR, it would manifest that no motive for the occurrence is alleged. Similarly situated co-accused Lilawati Devi has been granted anticipatory bail by a coordinate Bench of this Court, vide order dated 04.11.2025 passed in Cr.Misc. No. 71013 of 2025. Petitioner is lady and claims clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - II, Mohania, Kaimur (Bhabua) in connection with Ramgarh P.S. Case No.212/2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
