JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341, 323, 307, 379, 504, 506, 34 of the Indian Penal Code.

As per the prosecution case, petitioner and his mother came to the field of the informant and assaulted him with iron rod, as a result of which he sustained injuries and when his brother came to rescue the informant, he was also assaulted by the accused persons.

Learned counsel for the petitioner submits that the parties are gotia and on account of land dispute, simple maarpit took place between them. Case and Counter case. Informant side is aggressor and they entered into house of the petitioner for which Complaint Case No. 661 (C) of 2022 was lodged by

Patna High Court CR. MISC. No.74668 of 2022(2) dt.06-04-2023 2/2 mother of the petitioner. Both sides sustained injuries. With the intervention of well-wishers parties have entered into compromise. The petitioner has no criminal antecedent. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil (Lakho O.P.) P.S. case no.213 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
