Petitioner seeks bail in a case registered for the offence punishable under Section 302 of the Indian Penal Code. According to FIR, co-accused Mukesh Sah and Ranjeet Sharma allegedly gave dagger blow at the stomach of the uncle of the informant as a result whereof he died. While refusing prayer for bail to co-accused Mukesh Sah in Cr. Misc. No. 6221 of 2018, this Court had noticed the opinion of the Doctor while performing post mortem report that he had found penetrating wound at the abdomen of the deceased. Since allegation against the petitioner is similar to coaccused Vijendra Rai @ Naga Rai who has already been allowed

Patna High Court Cr.Misc. No.10186 of 2018 (3) dt.04-04-2018 2/2 bail by a Coordinate Bench of this Court vide order dated 16.01.2018 passed in Cr. Misc. No. 56009 of 2017 (Annexure 2). Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Koilwar Police Station Case No. 144 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
