The petitioner apprehends his arrest in connection with Aurangabad (Muffasil) P.S. Case No.129 of 2020, registered for the offence punishable under Sections 302, 201, 120(B) and 34 of the Indian Penal Code.

The case of the prosecution is that after getting information about the murder of a boy and a girl, the informant alongwith other police officials went at the place of occurrence and recovered semi burnt dead body of a boy and a girl. During the course of investigation it has come that there was love affair between the girl and the boy. On the alleged date of incident, the deceased girl namely, Amrita went to the house of deceased boy namely, Niraj and family members of Amrita went to the house of Niraj to take her, but she denied. It is alleged that all the accused persons took both the dead bodies for creamation, where police came and recovered the dead bodies. The motorcycle of the petitioner was recovered from the place of occurrence, therefore he has been made accused in the present case.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and have committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. Petitioner is the son-in-law of the co-accused Ravindra Singh and he went to his sasural for a couple of days, when he was going back to his place, his father-in-law requested him to leave behind the motorcycle for few days. On his request the petitioner agreed and left his motorcycle behind. He further submits that the petitioner is not named in the FIR, whereas some of the co-accused persons have been granted bail by different co-ordinate Benches of this Court. Learned APP for the State opposed the prayer for anticipatory bail and submits that the petitioner is also involved in the present case. He further submits that from the perusal of case diary it is apparent that there is ample evidence against the petitioner.

Having regard to the facts and circumstances of the case, the nature of offence, as there are two murders in the present case, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected.

Accordingly, this application is dismissed.
