JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-07-2020 Heard learned counsel appearing for the petitioners as well as learned Additional Public Prosecutor appearing for the State through video conferencing. Petitioners apprehend their arrest in connection with Complaint Case No.164-C of 2018 registered for the offences punishable under Sections 498(A), 323/ 379 of the I.P.C. and Section 3⁄4 of the D. P. Act.

Patna High Court CR. MISC. No.71150 of 2019(6) dt.10-07-2020 2/3 Petitioner no.1 is father in-law, petitioner no.2 is elder brother-in-law, petitioner no.3 is mother-in-law whereas petitioner no.4 is Gotini of the complainant. Although, all the aforesaid petitioners happen to be in-laws of the complainant and they are named in the complaint petition, but no specific overt act has been attributed against them.

The record goes to show that the notice was issued to opposite party no.2 and the said notice was received by mother of opposite party no.2. The petitioners have filed an affidavit to show that the mother of opposite party no.2 is residing jointly with opposite party no.2.

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within six weeks from the date of receipt of this order to the Court concerned, shall be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Subdivisional Judicial Magistrate, Khagaria in connection with
