The petitioner, in the present case, is seeking regular bail in connection with S.T. No. 121 of 0217 arising out of Kajra P.S. Case No. 02 of 2017, registered for offences alleged under Sections 147, 148, 149, 323, 324, 325,307,504 and 302 of the Indian Penal Code and Section 27 of the Arms Act . Learned counsel for the petitioner submits that there is no specific allegation of firing against this petitioner. It is submitted that the name of the petitioner has been mentioned in the column of accused as one of the eight accused in the F.I.R., therefore, it is difficult to believe that the informant could not name the person who had fired on the informant from pistol. Patna High Court Cr.Misc. No.3153 of 2018 (2) dt.18-01-2018 2/2 further submitted that the petitioner has no criminal history and one of the co-accused Kishore Yadav had already been granted regular bail by a co-ordinate Bench of this Court in Criminal Miscellaneous No. 41300 of 2017.
Learned APP opposed the prayer for bail.
Considering the facts and circumstances, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-I, Lakhisarai in connection with S.T. No. 121 of 2017 arising out of Kajra P.S. Case No. 02 of 2017 subject to the conditions U/S 437(3) Cr.P.C.
