ANJANA MISHRA ORAL ORDER 05-03-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 31.10.2017 in connection with Magadh Vishwavidalya P.S. Case No.101 of 2017 registered for the offence under Sections 363 and 365 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the entire case is false and fabricated, rather the same has been lodged only as a sequel to the intercaste marriage between the son of the present petitioner and the informant's daughter. It is further submitted that prior to the lodging of this case, an informatory petition, bearing Informatory Petition No.2251 of 2017, has been filed on

Patna High Court Cr.Misc. No.8171 of 2018 (3) dt.05-03-2018 2/2 5.8.2017 by the girl Priyanka Kumari and the boy Nitesh Kumar stating that they were apprehensive as they had entered into an inter-caste marriage and were apprehending trouble at the hands of the opposite parties, namely, Beem Saw, Naresh Sao and Guddu Sao. The present F.I.R. has been lodged by the wife of Late Jitendra Sao (the father of the victim girl Priyanka Kumari).

Having taken into consideration such facts and circumstances and also that the petitioner has been in custody for almost five months, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya, in connection with Magadh Vishwavidalya P.S. Case No.101 of 2017.
