JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-11-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 830 (C) of 2018, disclosing offences under Sections 467, 468, 471, 420, 406, 120B, 34 of IPC.

As per F.I.R. petitioner has sold the land to the husband of the complainant in the year 2015. After the death of her husband, complainant came to know that the same land has also been sold to some other villagers by the petitioner. Submission of the learned counsel for the petitioner is that the allegation is false and concocted. After the land sold to the husband of the complainant, the same has been mutated in the name of the husband of the complainant. The rent receipt

Patna High Court CR. MISC. No.70135 of 2019(2) dt.15-11-2019 2/2 has also been issued. Petitioner has not sold the land to some other villagers.

Heard learned A.P.P. as well as learned counsel for the opposite party no.2 also, who has opposed the prayer for anticipatory bail.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, surrender before the court below within a period of three weeks from the date of receipt of certified copy of this order, on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M. Nalanda at Biharsharif, in connection with Complaint Case No. 830 (C) of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure on condition that he has to appear before the learned trial court as and when required and co-operate in disposal of the trial, otherwise, his bail bonds shall be cancelled.
