The petitioner seeks bail in connection with Tatarpur P.S. Case No. 76 of 2019, registered under Sections 323, 307, 504, 506, 354B and 34 of the Indian Penal Code. The accusation is that after taking the dinner in the late evening 20.03.2019, informant, Sulekha Devi, and her husband, Raj Kumar Mandal, slept in the house. In the midnight, she along with her husband, woke-up due to sound of khat-khat on the door and her husband opened the door, then, saw that Raja Ram Kumar Singh, Abhimanyu Kumar Singh, Neeraj Kumar Singh and Suresh Prasad Singh variously armed with weapons, caught hold her husband, Raj Kumar Mandal. On the order of Suresh Prasad Singh, Raja Ram Kumar Singh caused injury through the butt of country made pistol near the
Patna High Court CR. MISC. No.68914 of 2019(3) dt.18-02-2020 2/2 eye of her husband. Petitioner also caused injury through iron rod at the head of her husband, but, same was slipped near left eye.
Submission is that only one injury is found on the injured husband of the informant, which is simple in nature. The petitioner is in custody since 02.06.2019. Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Tatarpur P.S. Case No. 76 of 2019 to the satisfaction of the Additional Chief Judicial Magistrate, Bhagalpur.
