Mr. SRI SATYENDRA NARAYAN SINGH ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 21-02-2018 Heard learned counsel for the petitioner and the learned APP for the State.
Petitioner, already in custody, seeks bail in connection with Maner P.S. Case No.143 of 2017, registered under Sections 147, 148, 149, 341, 323 and 307 of the Indian Penal Code as well as under Section 27 of the Arms Act.
Allegation in brief is that all accused persons came variously armed and the petitioner started opening fire causing fire arm injury to the daughter-in-law of the informant on her left scapular region.
Learned counsel for the petitioner submits that there is land dispute between both sides and complaint too was filed by the petitioner's side and due to the enmity the false implication is made.
Patna High Court Cr.Misc. No.2064 of 2018(4) dt.21-02-2018 2/2 Learned counsel for the informant submits that the allegation is specific against this petitioner only of causing fire arm injury to a lady inmate at the vital part. Having considered the said facts and circumstances, prayer of bail of the petitioner is rejected in connection with Maner P.S. Case No.143 of 2017, pending in the court of learned ACJM-VI, Danapur.
If the trial is not concluded within a year after framing of charge, the petitioner may renew his prayer of bail. (Arun Kumar, J) S.KUMAR/- U T
