The petitioner, in the present case, is seeking regular bail in connection with Kishanganj P.S. Case No.261 of 2017, registered for offences alleged under Section 394 of the Indian Penal Code.
Learned counsel for the petitioner submits that the FIR is against unknown, nothing has been recovered from the possession of this petitioner and despite the fact that this petitioner is in custody since 09.07.2017, till date no TIP has been conducted to identify him in connection with the offence alleged. He further submits that police has falsely implicated this petitioner in one after another case merely on suspicion. Learned counsel submits
Patna High Court Cr.Misc. No.4910 of 2018 (2) dt.02-02-2018 that save and except Bahadurganj P.S. Case No.161 of 2017 in all other cases, as stated in paragraph 3 of the bail application, he has been granted bail.
Learned counsel for the State is present.
Considering the facts and circumstances, let the petitioner, above named, be enlarged on bail, if not wanted in any other case, on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Kishanganj P.S. Case No.261 of 2017, subject to the conditions U/S 437(3) Cr.P.C.
