JUSTICE ARUN KUMAR ORAL ORDER 15-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Thawe PS Case No. 142 of 2017 registered under Sections 341, 323, 324, 326, 307, 447, 435, 436, 447, 504/34 and 302 of the IPC. The allegation in brief is that due to land dispute the accused persons are said to have assaulted informant side having specific allegation of assaulting on the head of the informant's brother by one Gopi Ram and Deva Ram by garasa and it is alleged that others assaulted his wife; in the meanwhile Deva Ram s said to have thrown his brother Raja Hussain in the fire causing his death and all have set fire in the hut of the informant.

Submission is that there is general and omnibus allegation against the petitioner of setting ablaze hut of the informant, however the allegation of killing Raja Hussain is against Deva Ram who has been admitted to bail by a coordinate Bench of this Court, there is also case and counter case between the parties and from the petitioner side also one person died.

Having considered the said facts and circumstances, the petitioner, namely, Yogendra Ram is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Gopalganj in connection with Thawe PS Case No. 142 of 2017.
