The petitioner seeks bail in connection with Hilsa P.S. Case No.668/2017 registered under Sections 30(A), 30(d), 38 of Bihar Prohibition and Excise Act, 2016.

Two liters of country made liquor is said to have been recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. The petitioner has been falsely implicated in this case. He has no concern with any business of liquor. The petitioner has got no criminal antecedent.

Patna High Court Cr.Misc. No.7727 of 2018 (2) dt.13-02-2018 2/2 Several other accused persons have been enlarged on bail by different co-ordinate Bench of this Court in Cr. Misc. No. 60458 of 2017, Cr. Misc. No. 60649 of 2017 and Cr. Misc. No.3866 of 2018 vide orders dated 21.12.2017, 21.12.2017 and 29.01.2018 respectively. The petitioner has been languishing in custody since 18.10.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judge-cum-Special Judge, Excise, Nalanda at Biharsharif, in connection with Hilsa P.S. Case No.668/2017. (Prakash Chandra Jaiswal, J) Amit/- U
