The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 409, 420 of the Indian Penal Code.
As per the FIR, it is alleged that this petitioner being Incharge Teacher and other co-accused persons have received the sub-standard articles supplied by the suppliers for the school without checking the quality during 28.03.2018 to 04.10.2021 and thus, committed financial irregularities. It is submitted that petitioner has been falsely implicated in this case. It is next submitted that earlier Bagaha PS Case No. 403 of 2021 was instituted against one Ashutosh
Patna High Court CR. MISC. No.3958 of 2023(2) dt.04-04-2023 2/2 Saran the then District Welfare Officer and the police after investigation submitted chargesheet against him and thereafter the present case has been lodged by the Incharge District Welfare Officer. At the relevant time petitioner was Headmaster/Incharge Teacher and has superannuated on 29.02.2020. Similarly situated co-accused have been granted bail by this Court vide order dated 24.03.2023 passed in Cr. Misc. No. 60705 of 2022. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.
10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, West Champaran at Bagaha in connection with Bagaha P.S. Case No. 479 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
