Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The petitioner is in custody since 15.09.2016.

Allegation against the petitioner is that he caused injury with Axe at the head of the father of the informant, as a result whereof, he died.

Earlier, this Court had refused prayer to the petitioner on 21.02.2017 in Cr.Misc.No.3589 of 2017 with direction to the learned Trial Judge to conclude the trial within nine months.

Patna High Court Cr.Misc. No.2353 of 2018 (3) dt.07-03-2018 The report of the learned Trial Judge dated 21.02.2018 would reveal that the matter is at the stage of prosecution evidence.

Considering the period already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.Tr.No.372 of 2017, arising out of Morhowrah Police Station Case No.264 of 2016, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
