JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 02-02-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner, in the present case, is seeking regular bail in connection with G.O. Case No.17 of 2017 (arising out of Keoti P.S. Case No.186 of 2017, registered for offences alleged under Sections 20b(ii) of the N.D.P.S. Act.

Learned counsel for the petitioner submits as per the FIR on secret informant that Ganja is being sold by this petitioner police conducted a raid. When the petitioner was trying to flee away he was apprehended by the police. On search of the petitioner police allegedly recovered two Dabba, in one Dabba 40 piece of Ceigrate filled with ganja and in another Dabba 20 gm Ganja was kept. Patna High Court Cr.Misc. No.4926 of 2018 (2) dt.02-02-2018 been made from the conscious possession of this petitioner. Learned counsel further submits that the petitioner has no criminal antecedent.

Learned counsel for the State is present.

Considering the submissions that the Ganja has not been recovered from the conscious possession of this petitioner and he has no criminal antecedent, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cumSpecial Judge, Darbhanga in connection with G.O. Case No.17 of 2017 (arising out of Keoti P.S. Case No.186 of 2017), subject to the conditions U/S 437(3) Cr.P.C. and subject to the further condition that in case he is found involved in any other case of similar nature in future, the investigating officer shall take steps for cancellation of his bail bond.
