JUSTICE ARUN KUMAR ORAL ORDER 17-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Rail Jamalpur P.S.Case No. 11 of 2017 registered under Sections 302/34 of the Indian penal Code and Section 27 of the Arms Act.

Allegation in brief is that informant's husband went to Bhagalpur to purchase medicine and informed her wife that he may come late and on the eve of too much delay, his wife went to station and found to accused persons assaulting him by lathi and danda and Santosh Yadav is said to have shot at him causing his death.

Submission is that in fact informant is not the eye witness and allegation of shooting at the deceased is against Santosh Yadav who has also confessed in his statement that he has shot on

No.4025 of 2018 (3) dt.17-02-2018 2/2 the deceased and he has not named this petitioner being present there rather has named some other persons and petitioner has only one criminal antecedent under the Bihar Excise Act and except that there is no any other criminal antecedent. Having considered the aforesaid facts and circumstances, the petitioner, namely, Mani Paswan, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Railway Magistrate (Kiul), Lakhisarai in connection with Rail Jamalpur P.S. Case No. 11 of 2017.
