2. The petitioner apprehends his arrest in a case registered for the offence under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 109, 103(1), 352, 351(2) of the Bhartiya Nyaya Sanhita, 2023.

3. As per the prosecution case, on 17.06.2025, all the accused persons named in the F.I.R. including petitioner along with 60-70 unknown persons came at the door of informant and started abusing and on protest, they assaulted husband of informant and other family members and later, husband of informant died.

4. Learned counsel for the petitioner submits that as per F.I.R. itself, specific accusation of assault is against other

Patna High Court CR. MISC. No.75716 of 2025(2) dt.11-11-2025 2/2 co-accused persons. So far as this petitioner is concerned, he is only alleged to be member of the mob and no specific role has been attributed to him. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, East Champaran, Motihari in connection with Banjariya P.S. Case No. 334 of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
