JUSTICE ARUN KUMAR ORAL ORDER 26-03-2018 Earlier by the previous order the person who has sworn affidavit of this bail application was directed to file show cause as the criminal antecedent of the petitioner was suppressed, despite giving sufficient opportunity no such explanation has been filed, so the Registry is directed to launch criminal prosecution against the person, who has sworn false affidavit, namely Sanjay Singh, son of Ranvijay Singh, aged about 28 years, resident of Village Amkola, PS Mohanpur, District Gaya.
Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 3.8.2016, seeks bail in Civil Lines PS Case No. 220 of 2016 registered under Sections 25(1b)a, 26 and 35 of the Arms Act. The allegation in brief is that the petitioner was apprehended by the police in possession of one live cartridge along with the stolen motorcycle.
Learned Counsel for the petitioner submits that the petitioner is in custody since 3.8.2016 but unable to disclose the present stage of the case in the trial court.
Learned Counsel for the State submits that the petitioner has
Patna High Court Cr.Misc. No.3548 of 2018 (5) dt.26-03-2018 suppressed the criminal antecedent, stating that he has no criminal antecedent though the prosecution pointed out that he is accused in two more cases.
Having considered the said facts and circumstances especially suppression of fact regarding criminal antecedent of the petitioner, his prayer for bail is rejected.
The trial court is directed to expedite the trial. Let a copy of this order be sent to the Registrar General for needful.
