The petitioner seeks bail in a case registered for the offence under Sections 302, 323, 341/34 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, there is land dispute between the parties and on account of the same, this petitioner has falsely been implicated in this case. The petitioner is rotting in judicial custody since 06.06.2019. Learned A.P.P. for the State assisted by the learned counsel for the informant has opposed the prayer for bail
Patna High Court CR. MISC. No.67872 of 2019(3) dt.05-03-2020 2/2 and submitted that the deceased was died due to Asphyxia produced by throttling. Moreover, the deceased before death was brutally assaulted by the petitioner as a result of which she has received six multiple injuries, which is evident from the Post Mortem Report.
Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of this petitioner is rejected. (Arvind Srivastava, J) brajesh/- U T
