2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 399, 402 & 414 of the Indian Penal Code and Sections 25(1b)a/26/35 of the Arms Act, registered in connection with Warsaliganj P.S.Case No. 114 of 2024.

3. As per allegation, the petitioner along with his other associates was planning to carry out illegal activities.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. Nothing was recovered from the possession of the petitioner, except one mobile set, which was of the informant

Patna High Court CR. MISC. No.86701 of 2024(3) dt.09-04-2025 2/2 himself. Learned counsel has also submitted that the petitioner is in custody since 13.03.2024 and in all the cases mentioned in para-3 of the bail petition, he is on bail.

5. On the other hand, Mr. J.N. Thakur, the learned APP for the State has opposed the prayer for bail.

6. Considering the above facts and circumstances, specially the period of incarceration, which is more than a year, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Nawada in connection with Warsaliganj P.S.Case No. 114 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
