Petitioner is accused in connection with Sabour P.S. Case No. 136 of 2019 registered under Sections 376(D) of the I.P.C. and section 3/4 of the POCSO Act.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in this case. In the instant case, F.I.R. is lodged after lapse of 15 days. The victim girl is major. Further submission is that on perusal of Medical Report, it appears that there is no sign of rape. It is also submitted that petitioner has no criminal antecedent and is in custody since 08.05.2019.

Having considered the facts and circumstances of the

Patna High Court CR. MISC. No.68280 of 2019(3) dt.18-12-2019 2/2 case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Special Judge (POCSO), Bhagalpur in connection with Sabour P.S. Case No. 136 of 2019.
