The petitioner is in custody since 08.08.2019 in connection with Gopalpur P.S. Case No. 46 of 2019 for the offence registered under Sections 467, 468, 471, 429 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the only allegation against the petitioner is that he along with the co-accused Sumitra Devi was trying to execute an agreement for sale/purchase of land belonging to the informant. It is further submitted that the petitioner has no role to play in the agreement so executed by said Sumitra Devi for sale/purchase of land but nevertheless he is being prosecuted on mere suspicion and presumption.
