Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366A and 34 of the Indian Penal Code and subsequently added Section 376 I.P.C and Sections 3 and 4 of POCSO Act.

Learned counsel for the petitioner submits that petitioner had earlier moved this court seeking regular bail by filing Cr. Misc No. 52898 of 2024 and the same was permitted to be withdrawn by an order dated 5-10-2024 with liberty to the petitioner to renew his prayer for bail after framing of charge. 4.

Learned counsel for the petitioner next submits that

Patna High Court CR. MISC. No.80558 of 2024(2) dt.31-01-2025 2/2 charges against the petitioner have been framed on 1-10-2024 (Annexure-3).

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the submission made by learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Kahalgoan P.S. Case No. 1415 of 2023.

However, if the learned trial court comes to a conclusion that the petitioner after his release is trying to delay the trial in any manner, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
