====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 07-02-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Section 341, 323, 354(B)/ 34 of the Indian Penal Code and Section 12 of POCSO Act. Allegedly, petitioner along with one other person pulled the informant's minor daughter with intention to molest her. Petitioner is said to have made video from his mobile and forced his daughter to keep quite on gun point.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No such occurrence as alleged ever took place. He has been falsely implicated in this case due to dirty village politics. There is direct allegation against the petitioner of sexually assaulting the

Learned APP for the State opposed the prayer for bail and submits that the victim is minor.

Considering the facts and circumstances of case and nature of the offence, I am not inclined to enlarge the petitioner on bail. The prayer for bail of the petitioner is hereby rejected. Accordingly, this application stands dismissed. (Anjani Kumar Sharan, J) divyanshi/- U T
