JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 28-03-2018 Heard learned counsel for the petitioner and learned counsel representing the State.

It appears that the prayer of the petitioner for grant of regular bail was earlier rejected by this Court finding that he is said to be the direct assailant.

Learned counsel for the petitioner has once again placed before this Court a copy of the order dated 15.9.2017 passed by a Co-ordinate Bench of this Court in Cr. Misc. No.36439 of 2017 (Baidnath Singh vs. The State of Bihar) and submits that the petitioner Baidnath Singh in the said case has been enlarged on bail even though there are allegations of firing against him as well.

Patna High Court Cr.Misc. No.15632 of 2018 (3) dt.28-03-2018 2/2 Learned counsel representing the State has pointed out from the order dated 15.9.2017 passed in Cr. Misc. No.36439 of 2017 that in fact Baidnath Singh was granted regular bail by a Co-ordinate Bench of this Court only when it was found that the inquest report bears one injury on the parietal region which is specifically attributed to the present petitioner. Considering the facts and circumstances once again, I find that there is specific allegation against this petitioner and in fact the inquest report also supports the allegation made in the F.I.R. I do no find any reason to take a different view. The bail application is rejected.
