Earlier the prayer for bail of the petitioner was rejected by this Court on merit, vide order dated 3.3.2017 passed in Cr. Misc. No.6754 of 2017.

Submission of the learned counsel for the petitioner is that one of the co-accused has been granted privilege of bail by a Co-ordinate Bench of this Court, vide order dated 21.3.2018 passed in Cr. Misc. No.3626 of 2018 and the case of the petitioner is similar to that of the co-accused and moreover, the petitioner has remained in custody since 11.11.2016.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.18557 of 2018 (2) dt.04-04-2018 2/2 circumstances, as stated above, and in view of the fact that other co-accused person has been granted bail having similar allegation, and the petitioner is in custody for more than ten months, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Distt. & Sessions Judge, Nalanda Biharsharif in connection with S.Tr. No.310 of 2017 arises from Laheri P.S.Case no.232 of 2016 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.

With the aforesaid observation, this application is allowed.
