The petitioner seeks bail in a case registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

151 liters of country made liquor is said to have been recovered from the dicky of the Honda City car but its driver managed to escape from the said car while driving licence and Aadhar Card of its driver were recovered. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern with the seized liquor. He was not

Patna High Court CR. MISC. No.70592 of 2019(2) dt.04-12-2019 2/2 present in the vehicle at the time of occurrence rather the car was being plied by its owner who managed to escape abandoning the said car seeing the police party. He has no criminal antecedent and has been languishing in custody since 28.08.2019.

Learned APP for the State opposed the bail petition.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge Excise, Rohtas, Sasaram in connection with Rajpur P.S. Case No.62 of 2019.
