JUSTICE BIRENDRA KUMAR ORAL ORDER 16-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 364/379 of the Indian Penal Code. Later on offence under Section 302 of the Indian Penal Code was added.

The FIR of the occurrence of abduction of the husband of the informant is against unknown. Subsequently, his dead body was found. Co-accused Kare Pandit, from whose possession the auto rickshaw of the deceased was recovered, has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No.58898 of 2017. Some other co-accused have already been allowed bail by this Court. Only material against the

Patna High Court Cr.Misc. No.20546 of 2018 (2) dt.16-04-2018 P2/ petitioner is suspicion. He is in custody since 03.08.2017. Investigation of the case is complete.

Considering the aforesaid material, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sessions Trial No.27 of 2018, arising out of K.Hat P.S. Case No.533 of 2017, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
