2. The petitioner seeks bail in connection with Ranitalab P.S. Case No. 481 of 2024 instituted for the offences punishable under Sections 80, 238 read with 3(5) of the BNS, 2023 and Section 3/4 of the dowry prohibition Act.
3. As per allegation in the FIR, it is case of dowry death of the deceased, namely, Muskan Kumari, due to non fulfilment of dowry demand by the petitioner and his family members and the petitioner is the mother-in-law of the deceased.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He submits that there is no any specific allegation against the petitioner and there is general

He further submits that petitioner is mother-in-law of the deceased and separated from the mess and business of the deceased and her family members. He next submits that the informant is not an eye witness of the occurrence. He lastly submits that fatherin-law of the deceased has been granted anticipatory bail by a Co-ordinate Bench of this Court and the anticipatory bail of the husband of the deceased is pending as submitted by learned counsel for the petitioner. Petitioner has got clean antecedent as stated in para 3 of the petition and is in custody since 17.05.2025.
5. Learned APP for the State opposes the prayer for bail.
6. From perusal of the FIR and impugned order of the learned Additional Sessions Judge-I, Danapur dated 05.08.2025, it appears that petitioner is named in the FIR. From perusal of the records, it appears that on the basis of the written report of the informant Phulpatiya Devi, (mother of the deceased) registered an FIR under Sections 80, 238 read with 3(5) of the BNS, 2023 and Section 3/4 of the dowry prohibition Act against 14 accused persons including the present petitioner. Patna High Court CR. MISC. No.74163 of 2025(2) dt.19-11-2025 3/3 law of the deceased has already been granted Anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 35562 of 2025 vide order dated 03.09.2025 and the anticipatory bail of the husband of the deceased is already pending, so considering all these aspects of the case and submission of learned counsel for the petitioner, I am inclined to grant bail to the petitioner.
7. Accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class Danapur, Patna / Concerned Court in connection with Ranitalab P.S.
