The petitioner is accused in connection with Case No. 474C2 of 2017, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is of recovery of 10 bottles, each containing 375 ML and 42 bottles, each containing 180 ML India made foreign liquor kept in a carton loaded on the ERickshaw, which was being driven by this petitioner. Learned counsel for the petitioner submits that, in fact, the petitioner who is E-Rickshaw driver after boarding the passengers moved for their destination. In the meantime, on signal other passengers were also boarded on the said

No.7715 of 2018(2) dt.08-02-2018 2/2 Rickshaw and left the alleged liquor in the rickshaw and petitioner was apprehended and remanded in the present case with alleged seized liquor. The petitioner has no criminal antecedent and he is in custody since 09.12.2017. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-VII, Begusarai-cumSpecial Judge-VII, Begusarai, in connection with Case No. 474C2 of 2017.
