JUSTICE MOHIT KUMAR SHAH ORAL ORDER 24-02-2023 Though the present petition has been filed for quashing the proceedings of the Encroachment Case No. 19/2019-20/20/2019-20, but, at the outset, the learned senior counsel for the petitioner has submitted that the petitioner has filed an appeal against the final order passed by the Circle Officer, Pachrukhi, Siwan in the aforesaid encroachment cases, bearing Appeal No. 66/2022-23, which is pending adjudication before the learned District Magistrate, Siwan, hence the same be directed to be disposed off expeditiously.

Patna High Court CWJC No.1009 of 2023(2) dt.24-02-2023 2/2 The learned counsel for the respondent-State submits that the aforesaid appeal would be decided forthwith in case the same has not already been decided.

Having regard to the short prayer made by the petitioner in the present petition, I deem it fit and proper to dispose off the present petition with a direction to the District Magistrate, Siwan to consider the aforesaid appeal filed by the petitioner bearing Appeal No. 66/2022-23 and dispose off the same by a reasoned and a speaking order in accordance with law within a period of six weeks of receipt/production of a copy of this order and till passing of the final order, status quo existing as on today qua the land/house of the petitioner in question shall be maintained.

The present writ petition stands disposed off on the aforesaid terms.
