JUSTICE ARUN KUMAR ORAL ORDER 20-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Kudhani PS Case No. 203 of 2013 (S.T. No. 646 of 2017) registered under Sections 302, 201, 328 and 34 of the IPC.

The allegation in brief is that wife and mother-in-law of the deceased were threatening him while alive and asked for money from him, so it is suspected that on account of that the accused persons have killed him by poisoning.

Learned Counsel for the petitioner submits that there was dispute, as per allegation, between the deceased, his wife and mother-in-law; whereas the petitioner is cousin of father-in-law of the deceased who is separate in residence and mess merely only being relative of these two persons he has been made accused and is in custody since 1.7.2017 having no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Md. Sajjad is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of 13th Additional Sessions Judge, Muzaffarpur in connection with Kudhani PS Case No. 203 of 2013 (S.T. No. 646 of 2017).
