1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Shrikrishna Puri Police Station Case No. 195 of 2023, disclosing offences under Sections 376 and 511 of the Indian Penal Code.

3. As per the First Information Report, the informant and the petitioner had cordial relations, being the neighbor, and on 16.04.2021, informant gave the petitioner a sum of Rs. 10 lacs, as loan, for the purpose of her job. When the informant demanded her money back, the petitioner became angry and threatened the informant.

4. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in the present case due to ulterior motive and there is no proof of payment to the petitioner by the informant. The acknowledgment

He next submits that even if the allegation is taken on its face value, the same gives rise to the civil dispute and there is no element of forgery on the part of the petitioner.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation, I am inclined to grant the petitioner privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, Manvita Kumari @ Moni, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna, in connection with Shrikrishna Puri Police Station Case No. 195 of 2023, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
