The petitioner, in the present case, is seeking regular bail in connection with Ara Town P.S. Case No.366 of 2017, registered for offences alleged under Sections 302 and 120B/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is not named in the FIR either as an order-giver or as a person who have participated in assault. He further submits that the allegations against some named accused persons is that they had fired and committed the alleged occurrence, some of them have been granted bail by different co-ordinate Benches of this Court. Some of the orders have been enclosed as Annexure-2.
Patna High Court Cr.Misc. No.4749 of 2018 (2) dt.01-02-2018 Learned counsel submits that there are two cases against the petitioner as stated in paragraph 3 of the application, but in both the cases he is on bail.
Learned counsel for the State is present.
Considering the fact that no material has been found to distinguish the case of this petitioner from the other co-accused who have been granted bail by different coordinate Benches of this Court, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Town P.S. Case No.366 of 2017, subject to the conditions U/S 437(3) Cr.P.C. and subject to the further condition that the petitioner shall cooperate in course of trial by putting appearance before the learned court below. Two consecutives defaults in putting appearance before the learned court below without any plausible reason shall lead to cancellation of his bail. (Rajeev Ranjan Prasad, J) Arvind/- U T
